月，国連の障害者権利委員会は，「日本の報告に関する総括所見」を公表した．この所見の懸念事項の一つとして「2017 年の「障害福祉サービス等の提供に係る意思決定支援ガイドライン」における「本人の最善の利益」という用語の使用」が指摘された．この指摘は，「一般的意見第 1 号（2014 年）「12 条；法律の前における平等な承認」」に記載されている「「最善の利益」の原則は，成人に関しては，第12 条に基づく保護措置ではない．障害のある人による，他の者との平等を基礎とした法的能力の権利の享有を確保するには，「意思と選好」のパラダイムが「最善の利益」のパラダイムに取ってかわらなければならない」という文言とこれを受けとめた日本障害フォーラム（JDF）によるパラレルレポートの見解を反映させたものである．この研究ノートでは，ソーシャルワーク実践の視点から，権利委員会によるこの懸念事項について，「パラダイム」概念の使用について検討を加えつつ，①どのような経過で曖昧ともいえるこの一文が挿入されたのか？　②この一文の挿入をどう理解すれば良いのか？　③そもそも「最善の利益」を含む「意思決定支援ガイドライン」をどう評価すべきか？　という問いに対して答えを導き出すことを目的として作成した．","subitem_description_language":"ja","subitem_description_type":"Abstract"}]},"item_10002_publisher_8":{"attribute_name":"出版者","attribute_value_mlt":[{"subitem_publisher":"日本福祉大学社会福祉学部,
